1、 WORKING PROCEDURE备用信用证操作流程I. VIA SWIFT PRE-ADVICE MT799/ MT760 SBLC PROCEDURE FACE VALUE ( Max 30,000,000.00 Usd/ Euro). 三千万美元、欧元以下的备用信用证操作流程。1. The provider will send the Issuing account coordinate to allow receiving bank check the interbank credit availability.开证方提供开证银行坐标给接证方查询同业额度是否有。2. Client P

2、rovide CIS including: Company Registration, Signatory Passport Copy, Latest Bank Statement copy, Full Bank Account Coordinates, Bank Approved Verbiage and Bank letter if available.接证方提供资料包括：商业登记证， 法人护照复印件，银行坐标，接证银行 760 版本(银行盖上章)，有可能的话额度函。3. Provider within 24 hours issue DOA Draft and complete, 开证方在

3、 24 个银行小时内提供已经填好的合同包括开证方基本资料：商业登记证， 法人护照，开证银行坐标。4. Buyer in 24 hours complete DOA, sign, stamp and send to Provider,接证方（买方）在 24 个银行小时内填好合同并且签字，盖章返回给开证方.5. Provider in 48 hours Sign, stamp and send back the signed DOA for Buyer filling. 开证方在 48 小时内签字盖章再返回给接证方（买家）做备案6. Receiver will Deposit 1% of the

4、first value in to lawyer firm escrow account. The lawyer firm will prepare and sign 3 parties escrow service agreement.接证方，开证方，与指定律师事务所（可由接证方指定律所）签署三方托管账户协议。接证方和开证方同时打票面额 1%至律师事务所的托管账户作为开证保证金。7. Provider Bank Issue Pre-advice Via SWIFT MT799 within 5 banking days according to Receiving bank approved

5、 Verbiage. The Provider should send the Swift Copy to Receiver via its Agent.开证方在 5 个银行工作日内根据接证银行版本通过 MT799 开出预开证。开证方通过代理商提供给接证方 MT799 报文。8. Within 72 Banking Hours upon receipt of MT799, Receiving should reply to Sending Bank Via MT799. If Receiving within 72 banking hours fails to reply, Receiver

6、must pay in RMB equivalent 100,000.00 Euro to Provider as compensation. The lawyer should deduct for the deposit amount.接证方收到预开证后在 72 小时内通过银行 SWIFT MT799 回复开证方。如果接证银行在 72 小时内未能回复， 接证方应该支付人民币等金额的十万欧元。律师事务所直接从已经锁定的 1%里扣除。9. Provider Bank Issue SBLC VIA SWIFT MT760 within 72 Banking Hours upon Receipt

7、of Reply from Receiving Bank, according to buyer bank approved verbiage. Provider shall send the stamped swift copy including answer back sheet to Receiver as proof of successful delivery of the instrument. The receiver should not for any reason claim the instrument is not received. Provider shall n

8、ot be reliable for any internal issues between receiver and its bank.收到接证方回复在 72 小时内开证方通过 SWIFT 开出 MT760 根据接证银行确认的版本, 开证方提供报文包括自动回复函作为开证成功依据。接证方不能以任何为由说证没收到。开证方不负责接证方与其银行相关问题造成的问题。10.The lawyer firm will release the security deposit （1% of face value） to provider designated account upon receipt, con

9、firmation and authenticate of the SBLC MT760.接证方收到，确认，验证 Swift MT760 之后律师事务所支付托管账户保证金（票面的 1%）到开证方指定账户。1. If provider within 10 banking days fail to issue MT799 or MT760, provider agent shall pay RMB_ to Receiver as compensation. 如果开证方在 10 个工作日未能开出 MT799 或 MT760，应该支付_人民币给接证方赔偿。11.Buyer within 5 to 7

10、banking days make the payment of balance due including all consulting fees. 接证方在 5 到 7 个银行工作日内支付余款以及所有佣金12.The Original hard copy may be send to buyer within 7 days at buyer request.在 7 天内开证方寄证原件给接证方按照其需要。-开证方银行信息：本业务不占用接证方银行授信额度以及不需要银行担保之类动作。接证方以收到的信用证去银行做流贷业务，到期银行自动托收无需另外还款。流贷资金出来后，开证方拿走 70%，10% 为综合财务顾问费，剩余 20%由接证方自行支配。开证总额度具体商议。
