摘要：近日，最高人民检察院出台不起诉新标准，并已公布实施。其中第四款：因生活无着偶然实施盗窃等轻微犯罪的犯罪嫌疑人的规定，存在着无法体现法律面前人人平等、无法起到预防犯罪、教育人民、惩罚犯罪的作用、“生活无着”、“偶然盗窃犯罪”无法界定问题的存在。笔者从司法实践的角度，重新审视了此规定存在的问题，提出了一系列解决问题的途径。关键词：法律依据；存在问题；解决途径Abstract： Recently， the Supreme People s Procuratorate announced a new standard not to prosecute has been published and implemented.
