3、内容等 】 四 、双方 责任和义务 甲乙双方在安排本培训项目的境内外各项活动中,应遵守 中国和 乙方 所在地的法律、 中2 国政府有关因公出国(境)管理规定和国家外国专家局关于出国(境)培训管理规定 ,甲乙双方各自的责任和义务为: (一 )甲方责任和义务 1.负责培训团组人员的组织工作,向乙方提供培训团组人员名单; 2.负责办理出国护照、签证等有关手续; 3.负责提出培训 要求 、培训日程、路线和授课教师资格等; 4.负责支付乙方为完成培训任务而经双方共同商定的费用; 5.负责跟踪了解 培训团组在境外期间的各项活动,给予政策引导和咨询; 6.不得向乙方提出违反出国(境)培训规定及外事纪律的要求

4、。 (二) 乙方责任和义务 1.负责向甲方签发邀请函; 2.负责按甲方的要求进行 课程 设计,配备高质量的师资和专业翻译,制订 行 程安排 并通过甲方报国家外国专家局出国培训 管理 司批准 后执行 ; 3.负责组织 专家 授课、对口交流 或实习 等业务实践活动 , 应 超过培训团组在境外日程的 2/3; 4.不得擅自改变培训课程、日程和路线,不得组织安排培训团组前往其他国家、未 经批准的城市 和 色情、赌博 场所 ; 5.负责培训团组 食、 宿 、行等接待 服务 工作; 6.负责给培训团组提供住宿条件 应达到的要求为 ; 7.保证培训团组 培训及公务 活动时 全程安排商务用车 和专业司机 接送

5、; 8.不得将培训团组转手给其它机构或团体接待; 9.及时反馈培训团组在境外期间的重要情况和问题, 或根据甲方的要求提供对培训团组在境外期间培训的质量评估及 相关情况; 10.不得给予培训团组或其他 人员任何回扣 ; 11.乙方对培训 合作情况、参训人员的个人和财务信息等应采取合理的保障措施,防止敏感信息泄露、滥用或未授权的使用或披露。 (三)双方协商后明确的其他责任和义务 五 、费用 及付款方式 1.甲乙 双方亦同意,由 _方负责为培训团组人员办理境外人身意外伤害和紧急医疗救助保险。 2.甲方 参团人员 按照 在中国政府 规定的标准 范围内 支付乙方出国(境)培训费用, 人均费用 _元(货币

6、名称)。 用于支付 : 培训授课、专业翻译及相关费用;培训团组的食宿行费用; _、 _、 _等费用。 (根据实际成行人数相应增减) 3.甲方 参团人员 在培训团组抵达 _ _国(地区)后向乙方交付培训费用(或甲3 乙双方协商确定 付款方式和时间进度 ); 4.乙方 应如实 为甲方出具培训费用的有效发票(包括 培训费、 住宿费和 城市间 交通费等 具体明细 ); 5.对 因团组人数变化、 行程变更、课程取消收取的费用或其他额外费用 ,或培训项目另有特殊要求的,应由甲乙双方协商解决。 六 、 争议或索赔的仲裁 本协议受中华人民共和国法律管辖。甲乙双方 同意 ,因本协议产生的任何争议或纠 纷 ,应友

9、ogram in (country or region) based on the following terms and conditions: 1. Topic, Time, Place and Number of Trainees a. Topic of the Training: b. The training group refers to a total of people designated by Party A for overseas training which will be conducted by Party B. c. Date of departure: yea

Purpose and Content of the Training To acquire knowledge of advanced technologies and methods for managing experiences on , , to improve the professional capabilities and management ability of the trainees. 12、 3. Methods of Training Party B should conduct the training by means of: a. Lectures by teachers: (specify the requirements of teachers professional level, minimum teaching hours, teaching scope and case analysis, etc.) b. Exchange visits or fieldwork: (specify visit time, place, agency to visit and

Responsibilities and Obligations During the overseas training, both parties should abide by the laws of China and the country in which Party B is located, and the policies and regulations on overseas training formulated by the Chinese government and the SAFEA. The respo

14、nsibilities and obligations of both parties come as follows: A. Responsibilities and Obligations of Party A a. Responsible for organizing the training group and giving the list of trainees to Party B. b. Responsible for going through passports, visas and related documents. c. Responsible for putting

15、 forward the training requirements, curriculum, itinerary and qualification of teachers, etc. d. Responsible for payment for the completion of the training agreed by both parties. e. Responsible for all overseas activities of the training group including providing guidance and consultation on relate

16、d policies. f. Not allowed to ask Party B for any requests that violate the regulations on overseas training and disciplines on foreign affairs. B. Responsibilities and Obligations of Party B a. Responsible for sending invitation letters to the Party A. b. Responsible for design of curriculum, selec

17、tion of high-qualified teachers and interpreters and design of itinerary in line with the requirements of Party A, and implementation of training activities approved by the Department of Overseas Training of SAFEA. c. Responsible for setting the hours of training activities like lectures, visits or

18、6 fieldwork totaling over two-thirds of the entire training hours. d. Not allowed to change the training curriculum and itinerary without approval. Not allowed to help the training group to travel to other countries or unapproved cities, or go to sites known to feature pornography or gambling. e. Re

19、sponsible for providing food, accommodation, transportation and other relevant services for the training group. f. Responsible for the confirming that the standard of accommodation arranged for the training group reaches the requirements of . g. Responsible for safe vehicles and professional drivers

20、 during the training period. h. Not allowed to transfer the training group to other organizations or agencies. i. Responsible for timely feedback of any important issues and situations during the training period or, as Party A requested, giving an evaluation report of the training group. j. Not allo

21、wed to pay kickbacks to the training group or any individuals. k. Responsible for safeguarding the integrity of the training cooperation, personal and financial information of trainees and the others. Any leakage, abuse or unauthorized use of sensitive information is prohibited. C. Other Responsibil

22、ities and Obligations Agreed by Both Parties a. b. c. . 5. Fees and Payment a. Based on the agreement of both parties, (Party A or Party B) should cover life accident insurance and emergency medical insurance for the trainees during the training period. b. Party A should pay Party B the fees of over

23、seas training within the financial standards set by the Chinese government, per capita training fee _ yuan (name of currency). 25、iate with each other regarding any changes of expenses or extra costs caused by change of number of trainees, itinerary, cancellation of training courses or special requirements for the need of training program. 6. Arbitration of Disputes or Claims This Agreement is under the laws of the Peoples Rep

26、ublic of China. Both parties agree to arbitrate the disputes to the China International Economic and Trade Arbitration Commission if no agreements can be achieved through friendly negotiation. The decision of the Arbitration Commission is final and binding upon both parties.
