In our country, the constitution stipulates that the mineral resources are owned by the central government, it has become a necessity to optimize its economic rational development with the help of the governments public power. How should we understand the e
5、conomic rationalization of the mineral resources? This article thinks that how to achieve orderly and green utilization of regional mineral resources constitutes a core question of the rationalization of the economics. Practice shows that in the areas with intensive mineral resources in the central
6、region of our country, driven by the single economic benefits, the unreasonable economic development mode delayed the regional economic transition time, and also led to the frequently occurring regional geological disasters. Interpretation of “public power“ 3In the analysis of the mechanism of the government function, we need to make the concept clear of the definition of “public power“, and the relationship with the private rights. For the interpretation of the latt
9、er, we need to consider the boundary issue to promote the rational development of mineral resource economy by the government under the market economy conditions. 1-1. The concept of “public power“ Power is the coercive power and the dominant power of the society or others that the specific main body
10、 (including individuals, organizations and nations) has within the scope of his responsibilities. And the state power (also known as the public power) is the main and the typical form of the modern power, which is a state power in the sense of the public law that the state organs and their working p
11、ersonnel shall exercise. Its prominent characteristic is the deterministic force, co-acting force and executive force while exercising with the state power as the essence. Generally speaking, the rights enjoyed according to the law are the public power. But while the legislation is not perfect, the
12、public power is not all “public law“ - because of the lag of the legislation itself and that the public power comes from the legislation is a pair of contradiction. Some modern scholars think that the 4law comes from the public will and the combination of the public interests. And the public law is
13、also the need for social development and the result of practice. Therefore, the public power to some extent is “ahead of the legislation, and then confirmed by the legislation“. The three basic power forms of the public power are namely the legislative power, the executive power and the judicial pow
14、er. 1-2. The relationship between the public power and the private right Human social life can be divided into two areas. One is the political national field, and the other is the field of civil society. Regulation of the former is the public law, such as the constitution, criminal law, administrati
15、ve law and so on. Regulation of the latter is the private law, mainly the civil law. In contrast, the rights enjoyed according to the public law are the public power, such as the legislative power, the administrative power, and the executive power and so on. The rights enjoyed according to the priva
16、te law are the private rights, such as the property rights, the personal rights and so on. The public law emphasizes the will of the state, and the private law emphasizes the individual will. And the two both oppose and integrate with each other. In the countries really 5implementing the rule of law
17、, the public power and the private right are in balance. Otherwise, if the public power extremely expands, it is the tyranny and is the centralization of the state power; if the private right extreme floods, it is the liberalism and is the anarchism. At present, the party and the government size up
18、the situation and put forward the goal of building a harmonious society. And the harmonious society is the society of coordinated and balanced pluralistic interest. The key of harmonious society lies in balancing the conflict between the interests of the state, social and public interests and the in
19、dividual interests, and coordinating the relationship between the public power and the private rights. Therefore the correct understanding and handling of the public power and the private right has the important theoretical significance and the practical significance of building a harmonious society
20、. The relationship between the public power and the private rights attracts many thinkers in the history of mankind. They stood in different positions and made a useful theoretical exploration from a different point of view, on the basis of the interests of different standards. The most representati
21、ve points of view which has exerted great influence on the later is mainly the following three: The first is the theory 6represented by Rock that “the civil is prior to the state and the society“. The second is the theory Hagel advocated that “the nation is higher than the civil and the society“. Th
22、e third is the theory of social structure of the dialectical materialism of Marx. Marx applied the method of social empirical and historical evidence, and starting from its historical development of the actual economic and social structure, profoundly reveals the relational properties, economic basi
23、s, historical process and the social significance of the mutual separation and the contradictory of the nation and the society in the process of Western modernization. Marx completely denied Hagels idealist view that the political nation determines the civil society, and pointed out that it is not t
24、hat the political country decided the civil society, but the civil society determines the state. Civil society “this name always makes the social organization developed for the production and communication, and this social organization forms the basis for the foundation of the country and the other
25、idealistic superstructures at all times.“ Therefore, the civil society is really a part of the country, and is the real basis and motive power of the nation, as well as a necessary condition and the existing form of the 7existence of the state. The relationship between the political state and the ci
26、vil society determines the modern form of social structure from two angles, and also determines the allocation of public power and private rights. On the one hand, the integration between private interests should establish the social mechanism with safeguarding and realizing individual private prope
27、rty rights as the center, and the confrontation and cooperation of the private interests. On the other hand, the fundamental purpose of the political state is to maximize the maintenance of private special interests. It is the rational basis of the countrys coming into being, existence and developme
28、nt. 2. The reflection on the present based on the interpretation On the foundation of the above analysis, we can reflect on the present situation from the following three aspects. 2-1. Asymmetric inter-generational power led to the uneven inter-generational distribution of resources. By the property
29、 of the power, power inequality between generations because of the reality that the resources are dominated by the contemporary people cannot define the property rights by bargaining because the offspring of people do not 8appear as an independent economic entity on the market in decision making. Th
30、e contemporary people have the absolute control of the resources, and thus have greater power than the next generations in the use of resources, which makes the future generations be congenitally deficient to acquire resources. Many domestic and foreign scholars have done a lot of research work on h
31、ow to ensure the long-term needs of economic development, optimum allocation of limited resources, and ensure that different generations have the same access to resources. Hotelling proposed the resource optimal exhaustion theory in as early as 1931. With the theory of market equilibrium, the time a
32、vailable for exhaustible resources was analyzed. According to the different needs, the hypothesis deduced the useful life of exhaustible resources, and certified that monopoly can prolong the service life of exhaustible resources more than free competition. 2-2. The territorial and non territorial p
33、ower asymmetry leads to excessive development of resources. Based on the current situation of the system model and management level of China, the high speed development has made many economists puzzled. Many scholars put forward the analysis of their own point of view. The point of view that the loc
34、al 9government competition led to the rapid development of Chinas overall economy is consistent with the reality of China. In the era of the planned economy, the central government is at the center of the power, dominating the allocation of social resources. The local government has no economic domi
35、nance, and the power distribution mode of resources makes the development lose power, and the social economy is inefficient. But in recent years the central policy with the economy as the main target leads to the regions economic development indicators as the local officials appraisal. Therefore, in
36、 the whole range there appears the competition with local zoning as the main competition among governments. In the stimulation of the market power, the local government as a “rational economic man” is devoted to the pursuit of profit in the market (Gao Yunfang, 2006). The local government has become
37、 the main competitor integrating a set of power and interest, but this competition actually lost the power restricting competition. The government power comes from the system, which is the political power, and lacks effective market restriction. The participation of the political power in the market
38、 can not guarantee the fairness of the competition. 2-3. Asymmetric public and corporate power are the main reason for the external resource utilization. 10The damage to the environment in the process of mineral resources exploitation and utilization is mainly reflected in three aspects: (1)It destr
39、oyed the renewable resources, so that it loses the ability to create value. The process of the mineral resource mining will destroy the land, forest, pasture and other natural resources, and renewable resources are of great value creation ability. Take the forest as an example. The growth of the for
40、est itself is creating the values, and also absorbs a lot of carbon dioxide in the growth process, which will reduce greenhouse gas, and can keep the surface soil moisture, reduce soil erosion and sand fixation, and reduce other natural disasters. Therefore in the entire natural system, the forest p
41、lays a modulatory role in a great environment. This is unable to replace by the human technology.(2)The losses brought by the natural disaster caused by the destruction to the environment in the process of mining. Whether it is the surface mining or the underground mining, it is a kind of destruction on the natural formation of the equilibrium of the geological structure. The geological effects to form a new equilibrium will have a great damage to the humans, such as the debris flow produced by the surface damage, the surface
